Abstract

The phenomenon of the potangan tradition in wedding practices in Brekat Village, Tegal Regency, emerges as a social practice rooted in the values of mutual cooperation and reciprocal interaction within the community. Initially, this tradition was understood as an expression of solidarity through voluntary contributions; however, over time it has undergone a shift in meaning into a social obligation with economic value, resembling debt-like practices. This condition creates social dynamics that both strengthen relationships among community members and generate social pressure, particularly for those with limited economic capacity. Therefore, this study aims to analyze the practice of the potangan tradition in weddings, examine the perspective of Islamic law on this tradition, and understand its position within civil law. The research questions are: first, how the practice and meaning of the potangan tradition are understood in Brekat Village; second, how Islamic law views the tradition; and third, how civil law evaluates the practice. This study employs a qualitative method with a sociological juridical approach. Primary data were obtained through interviews, observation, and documentation, while secondary data were collected from books, academic journals, and relevant legal sources. The findings indicate that, first, the potangan tradition has developed into a system involving record-keeping and equal repayment obligations, thus resembling debt transactions. Second, from the perspective of Islamic law, potangan falls under the concepts of ta’awun and ‘urf, which are permissible as long as they do not involve coercion and remain based on sincerity. Third, in civil law, potangan constitutes an unwritten agreement similar to lending and borrowing. Additionally, social sanctions such as gossip and reprimands reinforce community compliance. It is therefore recommended that this tradition be adjusted to preserve solidarity while minimizing social burdens and maintaining alignment with legal principles and sincerity.
